Waldo Outfitters LLC is committed to providing high quality, clean gear to our customers so that we may all camp comfortably and enjoy the outdoors. It’s important to understand and acknowledge that there are inherent risks associated with camping, hiking, and other outdoor activities for which Waldo Outfitters’ gear may be used. Waldo Outfitters will not be held responsible for any injuries, damages, or losses to the customer or others while using equipment rented from Waldo Outfitters. The purpose of these terms and conditions is to define the rules and outline what the customer’s responsibility is when renting gear and outdoor equipment from Waldo Outfitters.

EQUIPMENT RENTAL TERMS AND CONDITIONS 

All rentals are subject to the following terms and conditions: Equipment will only be rented to persons over the age of 18. Please review thoroughly before placing your order. 

START DATE: The Start Date submitted with your rental order should be the date you plan to pick-up the equipment. Pick-up time is 3:00pm; early pick up available upon request, 24 hours notice required. 

RETURN DATE: The Return Date is the day you plan to return the gear to Waldo Outfitters in clean and proper condition. Returns must be made by 3:00pm on the scheduled return date. 

PICK UP: Equipment can be picked up and returned according to the Start Date and Return Date policy at 7435 Grand Avenue, Kansas City MO 64114.

LATE CHARGES: If you do not return the gear to Waldo Outfitters by 3:00pm on the scheduled Return Date, you will be charged a one-time late fee of $25, plus the Daily Rental Rate for each day late until returned - up to the cost of equipment replacement. 

Late drop off can be arranged upon request between 3:00pm and 6:00pm for an additional $20.00.  

EARLY RETURNS: Rentals returned earlier than the Return Date will not receive refunds for any unused days.

RESERVATION/DEPOSITS/RENTAL FEES: To reserve equipment, you will make a deposit equal to the replacement cost of the equipment. At the time you make the deposit, you will be informed of the rental fees for the planned rental period. When you return the equipment, the deposit will be applied to your total charges for the actual rental charges, and for any damaged, lost or stolen equipment. The balance of the deposit will be returned or credited to you.

CANCELLATIONS: To receive a full refund, reservations must be canceled by 12 noon local time on the day before the reservation Start Date. Cancellations made after 12 noon of the day before the reservation Start Date will be charged for the first night of all items in the reservation. 

CLEANING: All equipment must be returned dry and free of mud and dirt. The presence of dirt, mud, mildew or mold will result in a cleaning charge of no less than $25 per item. The decision to clean, repair, or replace is at the sole discretion of Waldo Outfitters. 

DAMAGED GEAR: Waldo Outfitters understands that wear and tear is normal for gear and equipment that is used outdoors. The customer will not be charged for items that are returned with normal wear and tear. Items that are returned excessively damaged or show evidence of abuse will result in damage fees. Damages include, but are not limited to: tears, rips, stains, burn holes, missing pieces, along with evidence of mold and mildew. The customer will be charged the price to fix the gear or equipment due to customer damages. If the damages are beyond repair, the customer will be charged the price to replace the item. If the customer would like to keep the damaged-beyond-repair item, then Waldo Outfitters will send the item back to the customer and will not charge the customer more than the Manufacturers Suggested Retail Price (MSRP) for an item. 

LOSS/THEFT/NON-RETURN: You are responsible for the gear at all times between pick up and return to our facility. Waldo Outfitters provides no insurance against loss or theft. Lost or stolen items will be charged at the current Manufacturers Suggested Retail Price (MSRP) at the time of replacement. 

OWNERSHIP: The equipment is, and shall at all times be and remain, the sole and exclusive property of Waldo Outfitters; those renting from Waldo Outfitters shall have no right, title or interest therein or thereto except as expressly set forth in this Agreement.

IMDENMINFICATION: Customers of Waldo Outfitters and/or their authorized representative acknowledge full responsibility for personal injury or property damage and for the safety and well-being of all persons using the equipment while the equipment is rented from Waldo Outfitters. The customer holds harmless and indemnifies Waldo Outfitters for all claims, of any nature, that arise from the direct or indirect use and rental of the equipment by the organization or any use of the equipment by any person. The customer is responsible for any damage to the equipment during the rental period, including, at Waldo Outfitters’ sole discretion, repair or replacement.

LIMITED WARRANTY: Waldo Outfitters will warrant against material defects in the equipment it provides to the customer during the time of rental, and in the event the customer notifies Waldo Outfitters by the Return Date with details of the defect, Waldo Outfitters reserves the right to repair or replace the defective item, or to reduce the rental fee. Except for this express warranty, Waldo Outfitters, being solely a supplier and not a manufacturer, gives no warranty whatsoever and expressly DISCLAIMS ANY WARRANTY BY IT, EXPRESS OR IMPLIED, STATUTORY, BY OPERATION OF LAW OR OTHERWISE, INCLUDING MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE, and the only warranty on any materials rented from us is the express warranty, if any, given by the manufacturer of the item. Customer agrees that it has no right or remedy against Waldo Outfitters including, but not limited to, claims for INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OR ANY CAUSE, LOSS, ACTION, CLAIM OR DAMAGE WHATSOEVER, OR INJURY TO PERSON OR PROPERTY OR ANY OTHER CONSEQUENTIAL, ECONOMIC OR INCIDENTAL LOSS arising out of or related in any way to any item rented from us. Any liability of Waldo Outfitters to Customer shall be limited and shall not exceed the rental price of the item on which such liability is based.
